Food Safety Department
Food Safety and Management System means the adoption of Good Manufacturing Practices, Good Hygienic Practices, Hazard Analysis and Critical Control Point and Such other practices as may be specified by regulation, for the Food business. Food Safety and Standards Act, 2006 implemented throughout India from 05.08.2011 onwards.
Functions of Food Safety Department
Food Safety the Department regulates and monitors the Manufacture, Processing, Distribution, sale and import of food so as to ensure safe and wholesome food.
Responsibilities of the Food Business Operator
Every food Business Operator shall ensure that the articles of food satisfy the requirements of this Act and the rules and regulations made there under at all stages of production, processing, import, distribution and sale within the businesses under his control.
License and Registration of Food Business
No person shall commence or carry on any food business except under a licence. Food Business Operator’s Turn over below 12 lakhs per annum shall obtain registration certificate and if Food Business Operator’s turnover exceeds above 12 lakhs shall obtain License.
Details of License issuing Authority – The Designated Officer
All Food Business Operators – Retailer and Distributor Turn Over 12 lakhs per annum Upto 20 crores to be paid Rs.2000/- per year.
All Food Business Operators – Manufacturer including Re-packer, Re-labler Processing Unit including Packaged Drinking Water, BMCC, MCC Rs.3000/- (or) Rs.5000/- Per Year. (BMCC- Above 1 MT per day Production of Milk Solids per annuam Rs. 5000/- Below 1MT of production of Milk Solids per annum Rs.3000/-
Details of Registration Issuing Authority – The Food Safety Officer.
All Food Business Operators including Petty shop, Retailer, Manufacturer, Hotel and Other Food Business Operator falls under Registration Certificate Amount to be paid for Rs.100/- per year.
Analysis of Food
The Food Safety Officer may enter and inspect any place where the article of food is manufactured, or stored for sale, or stored for the manufacture of any other article of food, or exposed or exhibited for sale and where any adulterant is manufactured or kept, and take samples of such articles of food or adulterant for analysis.
Offenses and Penalty
Penalties are imposed to the Food Business Operator if the offence is proved based on the lab report of the suspected food sample by Adjudicating Officer/DRO (or) by Judicial Magistrate of Court under Food Safety and Standards Act.
